Agreement to Terms

These Terms and Conditions ("Terms") govern your use of The Website Providers website (thewebsiteproviders.com) and all services provided by The Website Providers. By placing an order, engaging our services, or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Our Services

The Website Providers offers a comprehensive range of digital services, including but not limited to:

  • Website Design: Custom homepage concepts, inner pages, banner designs, and responsive layouts
  • Website Development: CMS integration, custom PHP/WordPress development, e-commerce solutions
  • Logo Design: 2D, 3D, animated, and branded logo packages
  • Search Engine Optimization (SEO): On-page and off-page SEO strategies
  • Social Media Marketing (SMM): Social strategy, content, and campaign management
  • Content Writing: Professional copywriting for web pages, SEO, and marketing materials
  • App UI/UX Design: Mobile and web application interface design
  • App Development: Custom application development for iOS and Android platforms
  • Video Animation: 2D/3D animated explainer and promotional videos
  • Illustration: Custom digital illustrations and visual assets
  • Marketing Collateral: Brochures, flyers, banners, and print-ready marketing materials

All services are subject to a project proposal or package agreement outlining specific deliverables, timelines, and pricing. Package features and revision allocations vary based on the tier selected.

2. Project Process

All projects follow a structured workflow to ensure clarity, quality, and timely delivery:

  • Discovery & Consultation: We discuss your business goals, design preferences, and project requirements.
  • Proposal & Package Selection: We provide a clear proposal outlining deliverables, timelines, revision rounds, and total cost based on your selected package.
  • Full Upfront Payment: Full payment is collected before any project work commences.
  • Design & Development: Our team begins work once payment is confirmed.
  • Review & Revisions: Deliverables are shared for your feedback within the revision allocation of your package.
  • Final Delivery: The completed project is delivered in agreed formats upon your approval.

3. Payment Terms

All prices are quoted in US Dollars (USD) unless otherwise stated. The Website Providers operates on a 100% upfront payment model.

  • We accept payments via approved methods as stated in your invoice or order confirmation.
  • All quoted prices are inclusive of the deliverables outlined in your selected package.
  • Any additional services requested beyond the original package scope will be quoted and invoiced separately, with payment required before additional work begins.
  • Prices are subject to change. Any active project will be honored at the quoted rate at the time of purchase.

4. Refund & Cancellation Policy

We are committed to delivering exceptional quality and client satisfaction. We encourage clients to review all package details carefully before purchasing. Please read our refund and cancellation terms below:

Cancellation by Client Before Work Commences:

If you cancel your order before any work has been initiated, you are entitled to a full refund of the amount paid, minus a 10% administrative processing fee.

Cancellation by Client After Work Commences (Within 7 Days):

If cancellation is requested within 7 days of work commencing, a partial refund of up to 50% of the total amount paid may be issued, based on the volume of work completed at the time of the request. Work already completed is non-refundable.

Cancellation by Client After 7 Days of Project Commencement:

No refund will be issued for work already completed or actively in progress. You will receive all deliverables completed up to the point of cancellation.

After Final Delivery:

No refunds are issued once the final project files have been delivered and approved by the client.

Refund Eligibility:

  • Refunds may be considered if The Website Providers fails to deliver the agreed service within the mutually agreed timeline, excluding delays caused by the client (e.g., late feedback, missing content, or late approvals).
  • Refunds will not be granted for dissatisfaction arising from subjective creative preferences if the deliverable meets the agreed project brief and all included revision rounds have been utilized.
  • The full upfront payment is non-refundable once project work has commenced, unless The Website Providers is unable to fulfill the service.
  • Money-Back Guarantees advertised on specific packages are subject to these refund terms and apply only where the delivered work materially fails to meet the agreed package specifications.
  • Revision Policy: The number of revision rounds included in your project is determined by your selected package. Clients are encouraged to review package details carefully before purchase, as revision limits vary by tier. Additional revisions beyond the package allowance are available at an additional fee. Utilizing all entitled revision rounds before requesting a cancellation or refund is strongly encouraged.

Cancellation by The Website Providers:

We reserve the right to cancel a project if the client engages in abusive conduct, fails to provide necessary project materials within a reasonable timeframe, or requests content that violates our content policy or applicable law. In such cases, a prorated refund for uncompleted work will be issued.

How to Request a Refund or Cancellation:

5. Revision Policy

  • The number of revision rounds included in your project is defined by your selected package. Each package tier clearly outlines its revision allocation ranging from fixed revision rounds to unlimited revisions depending on the package chosen.
  • Revisions are defined as modifications within the original agreed-upon project scope and brief.
  • Requests that significantly alter the original brief, direction, or scope after work has commenced may be treated as a new project phase and quoted separately.
  • Additional revision rounds beyond your package entitlement are available at an additional fee, agreed upon in writing before work proceeds.
  • Clients are advised to consolidate feedback clearly in each revision round to ensure efficient turnaround.

6. Intellectual Property & Ownership

  • Upon full payment and final project delivery, all rights to the completed deliverables including design files, developed code, and creative assets are transferred to you, the client. The Website Providers retains no ownership of your final delivered work.
  • Any content, brand assets, or materials you provide to us remain your intellectual property.
  • Completed projects may be included in our portfolio unless you request otherwise in writing prior to final delivery.
  • Prior to full payment and final delivery, all work-in-progress materials remain the property of The Website Providers.
  • Source files are delivered as outlined in your selected package. Packages that include source file delivery (e.g., AI, PSD, EPS) will be provided upon project completion.

7. Client Responsibilities

To ensure a smooth and timely project, clients agree to:

  • Provide complete, accurate, and timely project briefs, content, and assets required to begin work
  • Make full upfront payment prior to project commencement as per the agreed invoice
  • Respond to design proofs, feedback requests, and revision rounds within a reasonable timeframe
  • Not request content that is defamatory, plagiarized, obscene, or otherwise unlawful
  • Understand that delays caused by late client feedback or missing materials may extend the agreed project timeline

8. Turnaround Times

Estimated delivery times are outlined in each package and begin from the date full payment is confirmed and all required project materials have been received from the client. Turnaround times are estimates and may vary based on project complexity, revision rounds, and client response times.

The Website Providers is not liable for delays caused by the client's failure to provide timely feedback, approvals, or project materials.

9. Confidentiality

Both parties agree to maintain strict confidentiality regarding all project-related information. The Website Providers will not disclose your project details, business information, or creative materials to any third party without your written consent, except as required by law or for the purpose of delivering the service.

10. Disclaimer of Warranties

Our services are provided on an "as is" basis. While we strive for excellence in every project, The Website Providers makes no guarantee of specific business outcomes, search engine rankings, social media growth, or revenue results following the delivery of any service.

We are not responsible for decisions made by third-party platforms, app stores, or search engines regarding the acceptance, ranking, or performance of your website or application.

11. Limitation of Liability

To the maximum extent permitted by law, The Website Providers shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to loss of profits, loss of data, or reputational harm.

Our total liability for any claim arising from our services shall not exceed the total fees paid by you for the specific project giving rise to the claim.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the applicable federal and state laws of the United States, reflecting our operations in both jurisdictions. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction in Ontario, Canada, or the applicable US state, at the election of The Website Providers.

13. Changes to These Terms

The Website Providers reserves the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the updated Terms. We recommend reviewing this page periodically.
